Orlando sued by Winter Garden family after their dog was allegedly killed by a police canine

ORLANDO - A fatal dog attack brought civil charges in Orange County Circuit Court. 

According to the complaint filed on April 8, a Winter Garden teen was taking his dog for a walk near his home on June 28, 2017 ,when a police canine, owned by defendant the City of Orlando and under the care of defendant Michael Zambito, ran up to the teen's dog unprovoked and attacked it. 

The teenager, plaintiff Neil J. Elliott, had to watch as his dog was fatally bitten in the neck by the violent police dog, which was ignoring defendant Zambito's commands and was uncontrollable due to its size and aggression. 

The complaint says Elliott immediately sought counseling because of the incident. 

The defendants are charged with negligence, strict liability and emotional distress.

Elliott and his father, Glenn Elliott, are represented by Payas, Payas and Payas LLP of Orlando.
