Class action lawsuit: Home Depot sold flooring that couldn't handle Florida's climate

TAMPA - A class action lawsuit against Home Depot accuses the home improvement store chain of selling flooring material not safe for Florida's climate. 

The complaint was filed on April 13 by plaintiff Nezha Medmoun in the Hillsborough County Circuit Court. Medmoun says she bought flooring from Home Depot in September of 2019 that was unbeknownst to her to be unsuitable for Florida climate conditions.

The plaintiff also alleges that Home Depot contracted flooring installers who were not properly trained and underqualified; U.S. Installation Group Inc. is also a named defendant in the suit. 

Toxic mold grew under and around the plaintiff's flooring and she says that the defendants refused to hire mold remediators; according to the complaint, Home Depot claimed the mold was a preexisting condition in the plaintiff's home, despite a plumber's verification of otherwise. 

The defendants are charged with violation of the Florida Deceptive and Unfair Trade Practices Act, breach of contract, negligence and breach of express warranty.

The plaintiff is represented by the Benkabbou Law Firm PLLC of Tampa.
