TAMPA - The Hillsborough County School Board and a former Chamberlain High School student are sued in the Hillsborough County Circuit Court after a student was stabbed multiple times, according to documents filed on March 12.
Plaintiff Mystique Briana Rogers was a sophomore at the Chamberlain High School at the time of the incident in March 2017. Rogers was in a class in which defendant Roselena Diaz Tavera was also a student. Rogers says that she was walking into the classroom and Tavera was standing in the doorway; Tavera allegedly pushed Rogers out into the hallway and stabbed her multiple times with a steak knife.
Tavera and Rogers had a history of physical violence against each other, according to the suit, and Rogers alleges that the school's staff, administration and safety officer did nothing to protect her from a historically violent classmate.
The defendants are charged with vicarious liability, failure to train, battery and alternative claim of negligence.
