Orange County man says mattress store is responsible for injuries he sustained attempting to move a boxspring alone

ORLANDO - An Orange County man sued the owners of the mattress store at 2402 Coolidge Avenue in Orlando after alleged store negligence caused a boxspring to topple over on him, according to documents filed on Jan. 22 in the Orange County Circuit Court. 

Plaintiff Darrel Wilson visited the store owned and operated by defendants TSW Mattress and TSW Global Services LLC in September 2020 to pick up a mattress and boxspring. According to the lawsuit, the store was attended by one employee who told Wilson he could either wait for the store's deliverymen to return and help with loading the box spring and mattress or he could do it himself. 

Wilson opted to load the furniture into his truck himself and was directed to the warehouse by the employee. The plaintiff says he was trying to nudge a large boxspring off of a stack of boxsprings when its size and height off the ground caused it to begin falling. The employee allegedly swiped the boxspring away from her, shoving the entirety of its weight and size onto the plaintiff, who sustained injuries including lacerations on the leg.

The plaintiff sues the mattress store for negligence in allowing a dangerous situation to occur and failure to provide clear instructions on mattress and boxspring retrieval; he is seeking damages in excess of $30,000.
