Customer alleges Lowe's Home Center negligence caused fall over pallet

CLEARWATER — A Pinellas County couple is suing Loew's Home Centers, alleging negligence caused injuries to the wife.

Patricia Cholak and Bobby Cholak filed a complaint Jan. 14 in Pinellas County Circuit Court against Lowe's Home Centers LLC, alleging the defendant negligently allowed a poorly placed pallet to remain outside its store. 

According to the complaint, on July 13, 2017, Patricia Cholak was legally on the premises of a Loew's in St. Petersburg, loading bags of mulch into her car when she tripped over a pallet on the premises and fell. As a result, she says she sustained physical injuries, causing her husband Bobby Cholak to lose the attention, companionship, services and society of his wife. 

The plaintiffs allege Lowe's Home Centers failed to warn Patricia Cholak of the dangerous condition on the premises when it knew or should have know it existed and failed to inspect premises for the dangerous condition such as the presence of the poorly placed pallet.

The Cholaks seek trial by jury, money damages of more than $15,000, including costs and all other appropriate relief. They are represented by attorney David A. Papa of Papa & Gipe PA in Clearwater.
