CLEARWATER — A property owner is suing an insurance company, citing alleged breach of contract.
Lori Godek filed a complaint on Jan. 7 in the 6th Judicial Circuit of Florida-Pinellas County against Citizens Property Insurance Corporation alleging that it breached its obligation to cover insured losses.
According to the complaint, between May 26, 2018, and May 26, 2019, Godek's dwelling sustained a covered loss due to water damage. Godek claims she notified the defendant of the damages and the insurance company assigned a date of loss.
Despite Godek complying with all conditions precedent to entitle her to recover under the policy, the defendant allegedly breached the contract by denying coverage.
The plaintiff holds Citizens Property Insurance Corporation responsible because it allegedly failed to provide coverage for all her losses.
The plaintiff requests a trial by jury and seeks judgment for consequential damages, attorney's fees and costs. She is represented by Morgan Vasigh of Morgan & Morgan, PA in Tampa.
