Chevy owner alleges vehicle damaged by neighbor's rotten tree branch

CLEARWATER — A St. Petersburg car owner is suing a neighbor, alleging negligence caused damages to his Chevrolet.

John Brushwood filed a complaint Jan. 3 in Pinellas County Circuit Court against Arnold Schoenberg, alleging the defendant failed to maintain a reasonably safe rental property, including the property’s trees and/or shrubbery.

According to the complaint, on June 11, 2018, a large, rotten branch from a tree on Schoenberg's property at 1433 26th St. N., St, Petersburg, crashed onto Brushwood's 2014 Chevrolet Cruze LTZ, totaling the vehicle. Brushwood says his car was lawfully parked in the street, between his property and Schoenberg's property. 

The plaintiff alleges Schoenberg failed to properly maintain the trees and/or shrubbery on his property.

Brushwood seeks trial by jury, damages of more than $15,000, court costs, interest allowable by law and any other proper and just relief. He is represented by attorney Paul T. Zeniewicz of PZ Law Firm PA in Orlando, Florida.
