St. Petersburg couple sues insurance company, citing failure to cover all damages

CLEARWATER — A St. Petersburg couple is suing Progressive Insurance, alleging breach of a policy regarding damages from a vehicle collision.

Dakotah and Intira Sky filed a complaint Dec. 19 in Pinellas County Circuit Court against Progressive Select Insurance Company, alleging failure to pay them uninsured/underinsured motorist benefits to which they are legally entitled.

According to the complaint, on Sept. 11, 2017, Dakotah Sky, who was driving his 2009 Subaru Forester, was involved in a violent auto collision at the intersection of 30th Avenue North and 16th Street North in St. Petersburg. The suit says the Subaru was hit by a vehicle negligently operated by an underinsured motorist.  

At the time of the occurrence, the lawsuit alleges, the Dakotah Sky's Progressive policy was in full force and effect. 

The lawsuit says Sky sustained serious injuries that resulted in total damages that exceeded the liability coverage. Intira Sky says she suffered the loss of her husband's service, support and consortium. 

The Skys seek trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. They are represented by attorney Frank DiCosola of Pinellas Park.
