Patient accuses health care providers of misdiagnosis

CLEARWATER — A Pinellas County patient is suing St. Petersburg health care providers, alleging they provided services below the applicable standard of care.

Daniel Mac Smith filed a complaint Dec. 5 in Pinellas County Circuit Court against Dr. Stephens J. Kennedy, and Radiology Associates of St. Petersburg PA, alleging they negligently misdiagnosed the plaintiff's March 23, 2016, CT scan that was corrected only on Dec. 31, 2016.

According to the complaint, due to previous testicular cancer issues, Smith had been undergoing surveillance CT scans on a regular basis. As a result of the defendants' negligent acts and omissions, the suit says, Smith's cancer went untreated and he had to undergo significant and aggressive treatment including chemotherapy as opposed to surgery. The lawsuit states this lead to pain, mental suffering and loss of enjoyment of life. 

The plaintiff alleges the defendants improperly interpreted the March 23, 2016, CT scan as being normal with no pelvic masses, when, in fact, the scan showed evidence of a recurring cancer.

Smith seeks trial by jury, damages of more than $15,000, with interest, court costs and attorney fees. He is represented by attorneys J. Emory Wood and Julian E. Wood, Jr. of Wood & Wood PA in St. Petersburg.
