Ocoee couple alleges city's improper sewage installation damaged home

ORLANDO — An Ocoee couple is suing the city, alleging breach of duty and negligence.

Alexander L. Simon and Irene P. Simon filed a complaint Nov. 29 in Orange County Circuit Court against the city of Ocoee and GML Coatings LLC, alleging the defendants improperly installed the bypass and/or failed to take appropriate action to prevent the backup of wastewater and raw sewage into the plaintiffs' home.

According to the complaint, on Sept. 24, GML Coating was under contract to the city of Ocoee to perform certain preventive maintenance to lift station No. 6 by the removal of sewage and wastewater from the plaintiffs' home at 648 Olympic Drive, Unit 14-4.

The Simons allege that after GML Coating had installed the bypass pumping system, the lift station failed to perform its functions, causing sewage to back up through the plumbing lines into the plaintiffs' home, thereby flooding their home with wastewater and raw sewage. 

The plaintiffs allege the city of Ocoee and GML Coatings failed to perform their functions. 

The Simons seek trial by jury, damages of more than $15,000, prejudgment interest, court costs and all other just relief. They are represented by attorney Eric W. Ludwig of Altamonte Springs.
