CLEARWATER — A Hillsborough County man has filed a lawsuit against Clearwater Beach resort and spa operators, alleging negligence caused injuries to the plaintiff.
Marcus Bennett filed a complaint Nov. 27 in Pinellas County Circuit Court against Columbia Sussex Corporation and John S. Taylor Properties LLC, alleging failure to provide safe ingress/egress.
According to the complaint, on Nov. 25, 2016, Bennett he was a patron of the defendants' Hilton Beach Resort and Spa in Clearwater when he tripped and fell due to a hazardous or dangerous condition. Bennett says he sustained serious injuries ,resulting in pain and suffering, disability, disfigurement, and loss of capacity for the enjoyment of life.
The plaintiff alleges the defendants failed to inspect the Hilton premises to ascertain whether the unreasonably dangerous conditions existed and failed to make it safe and to provide warning.
Bennett seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees and all other just and appropriate relief. He is represented by attorney Dereck Capaz of Capaz Law Firm PA in Tampa.
