Customer alleges Steak N Shake negligence caused fall

CLEARWATER — A Pinellas County man is suing Steak N Shake, alleging negligence caused him to fall and suffer injuries.

George Arbogast filed a complaint Nov. 27 in Pinellas County Circuit Court against Steak N Shake Inc., alleging failure to exercise reasonable care for the safety of its invitees.

According to the complaint, on Dec. 25, 2016, Arbogast was a customer at the Steak N Shake at 3853 Tampa Road, Oldsmar, when he slipped and fell on a substance that had been permitted to remain on the floor. The suit says Arbogast sustained injuries about his body and extremities and incurred medical expenses, loss of wages and loss of the ability to lead and enjoy a normal life. 

The plaintiff alleges Steak N Shake failed to ensure the floor of the restaurant was not left in a slippery and dangerous condition and failed to give adequate warning of the danger of slipping on the floor.

Arbogast seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. He is represented by attorney James R. Wilson of Morgan & Morgan PA in Tampa.
