Clearwater property owners allege insurer failed to cover sinkhole damage

CLEARWATER — Two Clearwater property owners are suing an insurer, alleging breach of contract.

Fatmir and Zeliha Kalemi filed a complaint Nov. 14 in Pinellas County Circuit Court against Safepoint Insurance Company, alleging failure to pay for damages caused by a sinkhole.

According to the complaint, on March 13, 2016, while the Kalemi property at 324 S. Glenwood Ave., Clearwater, was under a Safepoint homeowners insurance policy, it sustained a covered loss due to sinkhole damage. Although, the suit says, the defendant has already assigned a claim number and the Kalemis have complied with all conditions precedent to entitle them to recover under the policy, Safepoint has denied the claim. 

The plaintiffs allege Safepoint Insurance has failed to comply with the terms of the insurance policy and obligated the Kalemis to pay for attorney services in bringing legal action.

The Kalemis seek trial by jury. damages of more than $15,000, plus interest on any overdue payments, attorney fees and court costs. They are represented by attorney Sarah K. HibbaId of Morgan & Morgan Tampa PA.
