ORLANDO — An Orange County couple is suing an insurance company, alleging breach of contract to cover wind and rain damage.
Nostal Bonhomme and Clautilde Bonhomme filed a complaint Nov. 13 in Orange County Circuit Court against American Traditions Insurance Company, alleging the defendant failed to properly investigate, adjust, settle and pay the plaintiffs for a covered insurance claim.
According to the complaint, on Dec. 10, 2017, the Bonhomme home in Orange County suffered a covered loss due to wind, windborne material and rainwater. The suit says the Bonhommes made a claim to American Traditions in order to receive insurance coverage.
The Bonhommes say they complied with and performed all conditions precedent to recover under the policy but the defendant has denied their claims, and the plaintiffs have only received a small partial payment in regard to the covered loss.
The plaintiffs allege American Traditions Insurance has refused pay for all of the Bonhommes' property loss and damages that are covered under the insurance policy.
The Bonhommes seek trial by jury, damages of more than $15,000, attorney fees, court costs and all other just, proper and equitable relief. They are represented by attorney Jonathan Korin of Korin Law, PA in Miami.
