Customer blames Publix for fall over piece of wood

CLEARWATER — A customer is suing Publix, alleging negligence at its Palm Harbor store caused injuries to the plaintiff.

Dolores Ashman filed a complaint Nov. 1 in Pinellas County Circuit Court against Publix Super Markets Inc., alleging failure to provide a safe environment for business invitees.

According to the complaint, on Aug. 20, 2016, Ashman was lawfully in the premises of Publix Store No. 1340, 35439 U.S. Route 19 N., Palm Harbor. The suit says Ashman fell due to a piece of wood that was protruding from under a merchandise display shelf on the floor of the pharmacy department. The suit says the fall caused Ashman serious personal injuries, pain and suffering, disability, physical impairment, disfigurement, mental anguish, inconvenience, aggravation of a disease or physical defect, loss of capacity for the enjoyment of life, loss of earnings and medical expenses. 

The plaintiff alleges Publix Super Markets failed to inspect and remedy a dangerous condition on its property and failed to warn invitees of the dangerous condition.

Ashman seeks trial by jury, damages of more than $15,000 and all other just relief.  She is represented by attorneys Irwin Ast and Leidy N. Cuervo of Law Office of Irwin Ast in Miami.
