Chiropractor groups says Peak Property and Casualty denied coverage to accident victim

ORLANDO — A chiropractor group is suing an insurance company, alleging breach of contract in denying coverage to a car crash victim.

Modern Health Chiropractic LLC for Katrina Lilly filed a complaint Oct. 19 in Orange County Circuit Court against Peak Property and Casualty Insurance Corporation, alleging the defendant denied coverage for, withheld or reduced the medical bills that were submitted by the plaintiffs.

According to the complaint, on July 18, Lilly made claims for insurance coverage after she was involved in a motor vehicle accident. The suit says Modern Health Chiropractic and Lilly have performed the statutorily required conditions precedent to entitle them to recover benefits for damages sustained but allege they were denied coverage.

The plaintiffs allege Peak Property and Casualty Insurance continues to refuse to issue payment of all sums due the plaintiffs, in violation of Florida law, and in breach of its contact with claimant.

Modern Health Chiropractic and Lilly seek trial by jury, damages between $100 and $500, plus a pre-suit penalty, postage and interest, attorney fees, court costs and all other just and appropriate relief. Lilly is represented by attorney Gregory E. Gudin of Landau & Associates, PA in Hallandale Beach.
