ORLANDO — An assignor is suing Infinity Auto Insurance Company, citing alleged breach of contract.
Innovative Open MRI of Pensacola, LLC a/a/o Antwan Gillison filed a complaint on Oct. 19 in the 9th Judicial Circuit Court of Florida-Orange County against Infinity Auto Insurance Company alleging that the defendant breached its duty to comply with the required law with Florida statutes in providing covered loss under plaintiff's insurance policy.
According to the complaint, on July 11, 2018, Antwan Gillison gave notice of a covered loss to defendant after his insured vehicle was involved in a motor vehicle crash in which people sustained personal injuries.
Plaintiff claims he made a demand for No Fault Benefits for reasonable, necessary and related medical, rehabilitative and remedial treatment, but defendant allegedly did not make payment within 30 days after filling as required by Florida statute.
The plaintiff holds Infinity Auto Insurance Company responsible because the defendant allegedly failed to pay the plaintiff's covered loss despite the fact that it had no reasonable proof to establish that it was not responsible for payment.
The plaintiff requests a trial by jury and seeks judgment for benefits, together with pre-judgment interest, all interest on any past benefits not timely paid, postage, costs and attorney's fees. He is represented by Joshua A. Andone of Payas, Payas & Payas LLP in Orlando.
