Auto finance company alleges customer owes $22,000

CLEARWATER — An auto finance company is suing a customer, alleging breach of a retail installment sale contract and unjust enrichment in failing to pay more than $22,000.

TD Auto Finance LLC filed a complaint Oct. 17 in Pinellas Circuit Court against Elis Frank Cueva Hernandez, alleging the defendant defaulted under the terms of the contract.

According to the complaint, Hernandez purchased a motor vehicle and agreed to finance the car through TD Auto Finance. The suit says Hernandez owes the plaintiff f$22,407.19. 

The plaintiff alleges Hernandez has failed to make payments when due and took possession of the vehicle and then sold it.

TD Auto Finance seeks trial by jury, judgment of $22,407.19, plus court costs. It is represented by attorney Amy J. Winarsky of Marcadis Singer PA in Tampa.
