Former student alleges high school's negligence led to injuries

ORLANDO — A former student is suing the Orange County school system, alleging negligence caused injuries to the plaintiff.

Delia M. Lopez filed a complaint Oct. 12 in the Orange County Circuit Court against Orange County School Board, doing business as Orange County Public Schools alleging that the educational institution failed to keep and inform its teachers of the known medical syndromes of students.

According to the complaint, on Oct. 21, 2014, Lopez was a student at the defendant's Jones High School in Orlando when her phys ed teacher forced her to run a mile. The suit says this was even though the school knew or should have known of Lopez's  osteogenesis imperfecta diagnosis, and that running a mile would cause significant injuries. 

Lopez says she sustained bodily injuries, resulting in pain and suffering, mental anguish and loss of the capacity to enjoy life. The plaintiff alleges Orange County Public Schools failed to properly train and supervise its employees and/or agents.

Lopez seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney Michael B. Sanchez of The Pendas Law Firm in Orlando.
