Visitor alleges Winter Garden apartment operators' negligence led to her being shot

ORLANDO — An Orange County woman is suing Winter Park apartment complex operators, alleging negligence caused her to be shot.

Diante Horne filed a complaint Oct. 11 in Orange County Circuit Court against Bay Pointe Apartments LLC and Parent Management Company, alleging failure to provide reasonable security to prevent invitees from being injured.

According to the complaint, on Nov. 28, 2014, Horne was lawfully at the defendants’ housing complex, 1053 Horizon St., Winter Garden when she was shot by another patron. Horne says she sustained a gunshot wound, resulting in serious injury, pain and suffering, disability, loss of enjoyment of life and medical expenses. 

The plaintiff alleges the defendants failed to give adequate notice of the dangerous condition they knew or they should have known existed on their property.

Horne seeks trial by jury and damages in excess of $15,000. She is represented by attorney Brian M. Davis of Trial Pro PA in Orlando.
