CLEARWATER — A car repair service is suing an auto shop, citing alleged breach of duty and negligence.
Tiger Enterprises of Tyrone, Inc. filed a complaint on Sept. 27 in the 6th Judicial Circuit of Florida-Pinellas County against Frank's Body Shop, Inc. alleging that the defendant transported its customer's vehicle without proper care, causing the vehicle to strike plaintiff's premises.
According to the complaint, on Sept. 15, 2018, while unloading its customer's vehicle on a flat bed tow truck to plaintiff's premises, defendant allegedly permitted the vehicle to roll and drop off the rear of the of the flat bed tow truck, causing the vehicle to strike the rolling door on plaintiff's premises.
As a result, plaintiff's rolling door was damaged, was rendered inoperable and needs to be replaced, the complaint says, but the defendant allegedly refuses to pay for the plaintiff's damages.
The plaintiff holds Frank's Body Shop, Inc. responsible because the defendant allegedly unloaded its customer's vehicle in a negligent and careless manner and refused to pay for plaintiff's damages.
The plaintiff requests a trial by jury and seeks judgment for damages, plus prejudgment interest, costs, together with other relief as the court may deem just. They are represented by Thomas J. Dandar of Dandar Law Group, PA in Tampa.
