Virginia guest alleges negligence led to injuries in Buena Vista Palace hotel bathroom

ORLANDO — A Virginia hotel guest is suing a Lake Buena Vista hotel, alleging negligence led to injuries in her bathroom.

Rebecca Cassell filed a complaint Sept. 20 in Orange County Circuit Court against Royal Place Operating Leesee LLC, doing business as Buena Vista Palace and Royal Palace Owner LLC alleging that the defendants failed to to maintain the premises in a reasonably safe condition.

According to the complaint, on Sept. 21, 2014, Cassell was staying as a guest in the defendants' Buena Vista Palace hotel. The suit says Cassell stepped onto a partly detached skirt of the shower curtain in the bathroom, causing her to lose her footing and fall backward onto the floor. 

Cassell says she landed on her back, causing her to slide across the floor and forcefully strike her head on the bathroom door. As a result, the suit alleges, Cassell immediately experienced intense pain in her head and was diagnosed with an acute closed head injury. 

The plaintiff alleges the defendants failed to fully attached the shower curtain skirt in the bathroom, failed to inspect the conditions of the hotel room and its bathroom and failed to anticipate a known or reasonably discoverable hazardous condition.

Cassell seeks trial by jury, damages of $800,000, plus interest from Sept. 21, 2014, plus court costs. She is represented by attorney Daniel M. Landis of Landis and Mallinger PL in Boca Raton.
