Orlando property owner alleges contractors botched patio upgrade

ORLANDO — An Orlando property owner is suing contractors, alleging fraudulent misrepresentation and unjust enrichment.

Kenneth G. Roberts filed a complaint Sept. 17 in Orange County Circuit Court against TWP Contracting Inc. and Ted W. Plenge, alleging failure to perform their contractual obligations to upgrade the plaintiff's patio..

According to the complaint, on July 11, TWP Contracting and Plenge executed a proposal to repair and upgrade the patio at Roberts' property, 2003 Carrington Drive, Orlando. To date, the suit says, no work on the property has been initiated, causing Roberts to lose his deposit of $13,175.70. 

The plaintiff alleges TWP Contracting and Plenge, despite receiving the deposit, have failed perform the agreed-upon repairs and the upgrades set forth in the proposal.

Roberts seek trial by jury, damages of more than $15,000, with interest, court costs, attorney fees and all other just and proper remedies. He is represented by attorney Joshua M. Sachs of Henderson & Sachs PA in Orlando.
