Windemere resident alleges Insurance company failed to cover water damage

ORLANDO — A Windemre property owner is suing an insurance company, alleging breach of contract in failing to cover water loss damage.

Eloise Hammonds filed a complaint Sept. 12 in Orange County Circuit Court against Gulfstream Property & Casualty Insurance Company, alleging failure to provide coverage for the plaintiff's losses.

According to the complaint, on Jan. 21, 2016, Hammonds' property at 11348 Arborside Bend Way, Windemere, sustained damages during the policy period due to a water loss. 

Hammonds alleges she notified Gulfstream Property of the damages, and the insurance company assigned a claim with a date of loss. However, the suit says, Hammonds did not and continues not to receive any compensation under the policy. 

The plaintiff alleges Gulfstream Property & Casualty Insurance has failed or refused to fully perform under the policy, fully value Hammonds' losses and failed to fully pay for all of her losses as required by the insurance policy.

Hammonds seeks trial by jury, damages of more than $15,000, with interest on any overdue payments, attorney fees and court costs. She is represented by attorney Hans Kennon of Morgan & Morgan, PA in Orlando.
