Orlando resident alleges insurance company failed to cover hurricane damage

ORLANDO — An Orlando property owner is suing Liberty Mutual, alleging breach of an insurance contract.

Grace Plaza LLC filed a complaint Sept. 12 in Orange County Circuit Court against Liberty Mutual Insurance Company, alleging failure to fully compensate Plaza for all losses covered by the policy after a hurricane.

According to the complaint, on Sept. 11, 2017, Plaza's insured dwelling at 639 North Pine Hills Road, Orlando, suffered damages due to a sudden and unexpected intrusion of water as a result of Hurricane Irma. 

Plaza said she provided timely notice of the loss and made a claim to Liberty Mutual, seeking payment for her loss. The plaintiff alleges Liberty Mutual Insurance, despite admitting liability for the loss, paid benefits only after it reduced the coverage deductible and depreciation.

Plaza seeks trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney David Low of David Low & Associates, PA in Fort Lauderdale.
