Seminole couple alleges insurance company denied claim after hurricane

CLEARWATER — A Seminole couple is suing an insurance company, alleging breach of contract.

Ralph and Mary Swink filed a complaint Sept. 5 in Pinellas County Circuit Court against Homeowners Choice Property and Casualty Insurance Company, alleging failure to pay the plaintiffs all benefits due and owing under the policy after a hurricane.

According to the complaint, on Sept. 10, 2017, the Swinks' insured property at 11700 83rd Ave., Seminole, was damaged by wind from Hurricane Irma. The suit says they sustained a substantial loss to their real and personal property. 

The Swinks allege they duly made application for insurance benefits under the policy but Homeowners Choice has denied them both coverage and their repeated requests to reinspect the property to issue full payment.

The plaintiffs allege Homeowners Choice Property and Casualty Insurance has failed and refuses to pay the Swinks all benefits to which they are entitled for the loss.

The Swinks seek trial by jury, damages of more than $15,000, prejudgment interest, court costs, expert fees, attorney fees and all other just and reasonable relief. They are represented by attorney John W. Adams of Adams Law Association PA in Valrico.
