Customer accuses restaurant of negligence

CLEARWATER — A doughnut shop faces a lawsuit after a counter fell on a customer.

Allison Martinez filed a complaint on Aug. 30 in the 6th Judicial Circuit Court for Pinellas County against Clearwater Donut Network Inc. d/b/a Dunkin Donuts and Tampa Road Donuts Inc., alleging that they failed to use due care to maintain its premises in a safe condition.

According to the complaint, the plaintiff was an invitee at the restaurant located at 3720 Tampa Road in Oldsmar. A section of the counter broke off and struck plaintiff's body. The plaintiff claims she suffered injuries resulting in pain and suffering, aggravation of a pre-existing condition, disability, loss of capacity of the enjoyment of life, medical expenses and loss of earnings. 

The plaintiff claims defendants failed to maintain the premises in a safe condition.

The plaintiff requests a trial by jury and seeks judgment for damages in excess of $15,000. She is represented by Brian M. Davis of Trial Pro PA in Orlando.
