Cyclist blames Pinellas County business for allowing utility pole to block bike path

CLEARWATER — A bicyclist is suing a Pinellas County company, alleging negligence caused him injuries on a bike path.

Eric Toft filed a complaint Aug. 24 in Pinellas County Circuit Court against BroadSpectrum, alleging failure in maintaining the premises and otherwise keeping the public safe from dangerous conditions.

According to the complaint, on Nov. 30, 2015, Toft was riding his bicycle westbound on the Courtney Campbell bicycle path when his bike came into contact with a utility pole lying across the path. Toft says the premises owned by BroadSpectrum was negligently maintained, allowing a utility pole to cause a dangerous hazard to the public. 

The suit says Toft ran into the pole, leading to bodily injury, pain, suffering, disability, disfigurement, mental anguish and hospitalization. 

The plaintiff alleges BroadSpectrum failed to maintain the premises in a safe condition and failed to warn Toft and other patrons and/or customers and/or business invitees of the hazards on the premises.

Toft seeks trial by jury, damages that exceed of $15,000, plus court costs. He is represented by attorney Christian Denmon of St. Petersburg.
