Patient suffered permanent injuries after a misdiagnosis, lawsuit says

CLEARWATER — A former patient blames an emergency medical facility and a doctor for not properly treating him after a bicycle accident.

Ralph Flack filed a complaint on Aug. 3 in Pinellas County Circuit Court against Dr. Abigail S. Blackman and Emergency Physicians of St. Petersburg PA.

According to the complaint, Ralph Flack arrived at defendants' facility after a bicycle accident that initially rendered him unconscious. Flack claims he was discharged at the medical center despite not being able to walk as he could not feel his legs. 

He was later on diagnosed with permanent quadriparesis and incontinence of his bowels and bladder. He also has difficulty walking and using his arms. 

The plaintiff alleges the defendants failed to consult a neurosurgeon or competent trauma surgeon to perform surgical decompression and instrumentation to prevent further “spinal cord injury.”

The plaintiff requests a trial by jury and seeks judgment for damages, attorney's fees, all costs of action and other appropriate relief. He is represented by David R. Best and Matthew D. Best of Best Trial Attorneys PA in Orlando.
