Customer alleges grocery store owner's negligence caused injuries

ORLANDO — An Orange County woman is suing a Winter Garden grocery store owner, alleging negligence led to injuries for the plaintiff.

Marisol Hernandez filed a complaint Aug. 1 in Orange County Circuit Court against JJB Food Corp., doing business as Bravo Supermarket Winter Garden, alleging failure to maintain its premises in a safe condition.

According to the complaint, on Nov. 23, 2017, Hernandez visited the Bravo Supermarket, 624 South Dillard St., Winter Garden, to do some grocery shopping. The suit says Hernandez slipped and fell on a substance that was allowed by employees of the defendant to remain on the floor of the store. 

As a result of the defendant's negligence, Hernandez says, she sustained injuries in and about her body and extremities, resulting in pain and suffering, disability, disfigurement, scarring, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings and aggravation of a previous existing condition. 

The plaintiff alleges Bravo Supermarket Winter Garden failed to adequately maintain the floor free from slippery substances, failed to inspect or adequately warn the plaintiff of the danger of the floor and failed to adequately correct the dangerous condition of the floor of the store.

Hernandez seeks trial by jury, damages in excess of $15,000, plus interest and costs. She is represented by attorney Michael R. Vaughn of Morgan & Morgan PA in Orlando.
