ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of a contract.
Gilberto Roman filed a complaint July 30 in Orange County Circuit Court against Anchor Property & Casualty Insurance Company, alleging failure to adequately indemnify the plaintiff for a loss.
According to the complaint, on Sept. 10, 2017, while his policy was in full force and effect, Roman's property, 7052 Carna Court, Orlando, sustained a covered loss as a result of wind, wind-driven rain, and/or hail from Hurricane Irma. Roman says he paid all premiums due and owing as contemplated by the insurance policy but failed to receive insurance proceeds to repair his property.
The plaintiff alleges Anchor Property & Casualty Insurance has failed to adequately indemnify Roman for the loss and failed to tender an appropriate amount to repair the property.
Roman seeks trial by jury, damages that exceed $15,000, plus interest, court costs, and reasonable attorney fees. He is represented by attorney Louis A. Gonzalez of Vargas Gonzalez Hevia Baldwin LLP in Winter Park.
