Customer alleges flooring companies failed to install tiles

CLEARWATER — A St. Petersburg woman is suing flooring companies, alleging breach of contract, fraud and negligent misrepresentation.

Kim Ramer filed a complaint July 30 in Pinellas County Circuit Court against Butler Carpet Company, doing business as Bob's Carpet Mart and Flooring and Matt & Collen's Tile Service LLC, alleging violation of the Magnusson Moss Act by failing to comply with agreed warranties during the installation of new tiles.

According to the complaint, on Oct. 25, 2017, Ramer entered into a binding contract with the defendants in which they promised to replace the tile, laminate and carpet flooring of her residential property at 11238 Kapok Grand Circle, St. Petersburg. 

Together with written express warranties and contracts was the condition that the work be completed no later than Nov. 15, 2017. However, Ramer says, instead of the quality workmanship that had been promised, her home was damaged and the work was not performed as contracted. 

As a result, Ramer says, she had to leave her residence and find lodging elsewhere as the defendants were unable to correct the defects in the work, or to remediate the damages caused. 

The plaintiff alleges Bob's Carpet Mart and Flooring and Matt & Collen's Tile Service failed to use standard and accepted methods of flooring installation, and damaged her personal property during the installation.

Ramer seeks trial by jury, damages of more than $15,000, interest and costs and all other just and proper relief. She is represented by attorneys Martha Bolton and  Patrick M. O'Connor of O'Connor Law Firm in Clearwater.
