Homeowners sue Castle Key Insurance, alleging breach of contract

ORLANDO — Homeowners are suing Castle Key Insurance Co., citing alleged breach of contract.

Lillie and Collin Patrick filed a complaint on July 25, in the 9th Judicial Circuit Court for Florida, Orange County, against Castle Key Insurance Co., alleging that the insurer breached its duty of good faith and fair dealings.

According to the complaint, the plaintiffs allege that while their property located at 5614 Balboa Drive in Orlando was insured under a homeowner's insurance policy, it sustained a covered loss for water damage, which required necessary repairs and replacements, cleaning and other remedial measures. 

However, despite efforts of plaintiffs to furnished timely notice of covered loss, the defendant refused to pay either part or all of plaintiffs' insurance claim. 

The plaintiffs hold Castle Key Insurance responsible because the defendant allegedly failed to provide coverage for all of plaintiffs’ losses, and obligated plaintiffs to retain the services of an attorney to prosecute action.

The plaintiffs request a trial by jury and seek judgment against defendant for all losses with interest, incidental and consequential damages, plus attorney's fees and costs. They are represented by Maria A. Morris of The Nation Law Firm LLP in Longwood, Florida.
