ORLANDO — An Orlando property owner is suing an insurance company, alleging breach of contract.
Ferdinand V. Salicrup filed a complaint June 22 in Orange County Circuit Court against Modern USA Insurance Company, alleging the defendant failed to provide proceeds under the policy for hurricane damage.
According to the complaint, on June 7, after timely notifying Modern USA and making his dwelling at 1273 Tyler Lake Circle, Orlando, available for inspection after damage done the previous September by Hurricane Irma, Salicrup was denied coverage.
Furthermore, the suit says, the defendant attempted to invoke an "Our Option" clause and has acknowledged that the losses Salicrup sustained are covered losses under the policy of insurance, despite denying the insurance proceeds.
The plaintiff alleges Modern USA Insurance has refused to pay his claim, including the improper denial of the claim and improper invalid invocation of the "Our Option" clause.
Salicrup seeks trial by jury, benefits greater than $15,000, general, compensatory and consequential damages, attorney fees, all taxable costs and all further just, equitable and proper relief. He is represented by attorney Jeremy Schilling of Loughren, Doyle & Reising PA in Fort Lauderdale.
