CLEARWATER — A Paseo County driver is suing another motorist, alleging insufficient measures were taken to prevent injuries from a collision.
Alfredo Russo filed a complaint June 21 in Pinellas County Circuit Court against Francis Kapusinsky alleging the defendant negligently maintained and operated a motor vehicle, resulting in collision.
According to the complaint, on Oct. 27, 2016, Russo was driving his 2007 Ford Focus, with his wife as sole passenger, southbound in the outside lane of U.S. Highway 19 North approaching Curlew Road in Clearwater. The suit says Kapusinsky negligently performed a left-hand turn across the southbound lanes and drove his 2015 Hyundai Elantra into the path of Russo's vehicle, resulting in a collision.
As a result, Russo says he suffered severe bodily injuries, pain, disability, mental anguish, expense of hospitalization, medical care and treatment, and damages to property.
The plaintiff alleges Kapusinsky negligently failed to exercise reasonable care in maintaining and operating a motor vehicle so as not to cause harm to other drivers and motorists.
Russo seeks trial by jury, damages exceeding $15,000, exclusive of costs, interest, attorney fees and all other relief the court deems just and proper. He is represented by attorney Christopher DeBari of Law Offices of Christopher DeBari, LLC in Tampa.
