Individuals are suing motorist and insurer for negligence

CLEARWATER — Individuals are suing Ekaterina Usacheva and Geico General Insurance Company, motorist and insurer, citing alleged breach of contract and negligence.

Steven Johnson and Grissel Rohena filed a complaint on June 21 in Pinellas Circuit Court against the defendants alleging that they failed to exercise standard care and skill in the operation of a vehicle.

According to the complaint, the plaintiffs allege that on May 2, 2017, Steven Johnson and Grissel Rohena suffered bodily injury, pain and suffering, impairment, disability, inconvenience, aggravation of a pre-existing condition, mental anguish, loss of earnings and incurred medical expenses as a result of the negligence of Defendant Usacheva in operating a vehicle so that it collided with plaintiffs' motor vehicle, while defendant Geico refused to provide benefits under the underinsured motorists’ insurance policy. 

The plaintiffs hold Ekaterina Usacheva and Geico General Insurance Company responsible because the defendants allegedly failed to safely operate a vehicle so as not to cause damage, failed to compensate plaintiff under the uninsured/underinsured motorist insurance policy and forced plaintiff to retain and pay for the services of legal counsel.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount in excess of $15,000. They are represented by Darrell W. Kropog Jr. of Morgan & Morgan Tampa PA in St. Petersburg.
