Health care provider accused of violating FCCPA

CLEARWATER — A Pinellas County man is suing a local health systems company, alleging violation of the Florida Consumer Collection Practices Act (FCCPA).

Robert Scarpetta filed a complaint June 21 in Pinellas Circuit Court against Baycare Health Systems Inc., alleging the defendant was abusive and unfair in its debt collection practices.

According to the complaint, on March 2, 2017, Scarpetta was provided medical goods and services by the defendant. Since then, the suit says, he has been abused, harassedand made worried and anxious, as a result of the illicit debt collection efforts by the defendant.

The suit says Baycare Health Systems is attempting to collect on an alleged debt, despite legal counsel writing to the defendant on behalf of plaintiff and despite Scarpetta having previously sued the defendant for contacting him directly. 

The plaintiff alleges Baycare Health Systems threatened to enforce an illegitimate debt, and has communicated directly with Scarpetta despite knowing he is being represented by an attorney.

Scarpetta seeks trial by jury, damages of more than $15,000, court costs, interest, attorney fees, injunctive and declaratory relief, and all other relief the court deems appropriate. He is represented by attorney Richard Peck of Elkin-Peck PLLC in Spring Hill.
