ORLANDO — Two Orlando homeowners are suing an insurer, alleging breach of an insurance contact.
Victor Perez and Ivette Valenti-Perez filed a complaint June 11 in Orange County Circuit Court against Florida Specialty Insurance Company, alleging failure to perform its contractual obligations regarding hurricane damage.
According to the complaint, on Sept. 10, 2017, the Perezes' dwelling at 9840 Dogwood Ridge Run, Orlando, sustained storm damage from Hurricane Irma. Subsequently, the suit says, the plaintiffs notified Florida Specialty of the damages, and the defendant assigned a claim number to the loss but has yet to make payments.
The plaintiffs allege Florida Specialty Insurance has failed and refuses to pay, to replace and/or repair the plaintiffs’ dwelling.
The Perezes seek trial by jury, damages of more than $15,000 for all covered losses with interest, attorney fees and court costs. They are represented by attorney H. Xavier Carrera of The Nation Law Firm LLP in Longwood.
