ORLANDO — Two Winter Park property owners are suing a liability insurer, alleging breach of an insurance contract.
Gerardo Martinez and Claudine Martinez filed a complaint June 11 in Orange County Circuit Court against Homeowners Choice Property & Casualty Insurance Company Inc., alleging the refusal to pay the full amount owed under the contract.
According to the complaint, on Sept. 11, 2017, the Martinezes' insured property at 785 Carnation Drive, Winter Park, sustained physical damages due to Hurricane Irma. At the time of the incident, the suit says, the insurance policy issued by Homeowners Choice was in full force and effect.
The plaintiffs allege Homeowners Choice Property & Casualty Insurance failed to provide complete coverage for the physical damages that occurred during the contract period.
The Martinezes seek trial by jury, damages of more than $15,000 owed under the contract, with interest, attorney fees and court costs. They are represented by attorneys Max M. Messinger and Pritpal Singh of Kanner & Pintaluga PA in Boca Raton.
