Motorist alleges driver, vehicle owner caused crash

CLEARWATER — A motorist is suing a driver and vehicle owner, alleging negligence, and an insurance company, alleging breach of contract due to a vehicular crash in Clearwater.

Jason McGarry filed a complaint June 5 in Pinellas County Circuit Court against Dylan M. Christopher, Christine L. Christopher and Progressive Select Insurance Company, alleging the defendants failed to exercise reasonable care in operating and maintaining a motor vehicle and refusing to pay uninsured motorist benefits.

According to the complaint, on Aug. 18, 2017, McGarry was driving eastbound on Drew Street near the intersection of North Missouri Avenue in Clearwater. The suit says another vehicle driven by Dylan Christopher and owned by Christine Christopher collided with McGarry's vehicel.

The suit alleges this resulted in bodily injuries to McGarry, causing pain, disability, mental anguish, damage to property and expense of hospitalization, medical care and treatment. 

At the time of the accident, McGarry says he was insured, and Progressive Select agreed to provide uninsured motorist coverage. However, the suit says, the insurer failed or refused to pay insurance benefits. 

The plaintiff alleges the defendants failed to exercise reasonable care in operating and maintaining a motor vehicle and the  insurer has refused to pay uninsured motorist benefits.

McGarry seeks trial by jury, damages in excess of $15,000, exclusive of costs, interest, attorney fees and all other relief deemed just and proper. He is represented by attorney Justin W. Pimenta of Abrahamson & Uiterwyk in Tampa.
