Apopka Walmart shopper alleges strap caused fall

ORLANDO – A Walmart shopper alleges a packing strap caused him to fall.

Ernest Magnelli filed a complaint on May 25 in the Orange County Circuit Court against Walmart Inc., formerly known as Wal-Mart Stores Inc., alleging negligence.

According to the complaint, the plaintiff alleges that on May 29, 2014, he suffered injuries to his head, neck, body and extremities when he tripped, slipped and fell while shopping at the defendant's Apopka store. He alleges the dangerous condition was caused by a packing strap dropped on the floor by an employee.

The plaintiff holds Walmart Inc. responsible because the defendant allegedly failed to properly maintain or operate its premises, failed to have the dangerous condition corrected and warn plaintiff of its existence.

The plaintiff seeks judgment against defendant for damages of more than $15,000, exclusive of interest, costs and attorney’s fees. He is represented by Arnold I. Levy of Law Offices of Arnold I. Levy PA in Miami.
