Super 8 Motel guest seeks more than $15,000 after fall in bathroom

CLEARWATER – A guest alleges he was injured at a Clearwater hotel because of a bathroom's dangerous condition.

John Mackenzie filed a complaint on May 29 in the Pinellas Circuit Court against Jai Laxmi LLC, doing business as Super 8 Motel, alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 15, 2017, he was on defendant's Super 8 by Wyndham Clearwater/St. Petersburg Airport when he slipped on the smooth-bottomed bathtub unit and fell on his left shoulder and side. He alleges a bath mat was not present in his room and the tub unit did not have any handles or rails.

The plaintiff holds Jai Laxmi LLC responsible because the defendant allegedly failed to install proper non-slip tubs for and failed to warn plaintiff about the removal of its bath mats.

The plaintiff seeks judgment against defendant for an amount of more than $15,000, plus costs and interest. He is represented by Dane C. Heptner of Perenich, Caulfield, Avril & Noyes PA in Clearwater.
