Woman sues rental property owner, citing unsafe conditions

CLEARWATER — An invitee is suing the William D. Stark Trust, a rental property owner, alleging insufficient measures were taken to prevent injuries.

Felicia Cosby filed a complaint on May 16 in the Pinellas Circuit Court against the William D. Stark Trust alleging that the rental property owner failed to maintain its rental property in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Sept 13, 2016, she was injured in and about her body and extremities while stepping down from the living quarters to the Florida room at the defendant's rental property. She has incurred medical expenses, pain and suffering and loss of wage earning capacity. The plaintiff holds William D. Stark Trust responsible because the defendant allegedly failed to inspect the floor space in and around the metal transition piece at the top of the step from the main living quarters to the Florida room and failed to adequately warn plaintiff of the danger of tripping.

The plaintiff requests a trial by jury and seeks damages in excess of $15,000, and requests a trial by jury of all issues triable by a jury. She is represented by Michael C. Bird of Morgan & Morgan, Tampa PA in Tampa.
