CLEARWATER — An employee is suing Florida Mobile Rehab LLC d/b/a Salus, a foreign corporation, citing alleged breach of contract, unpaid wages, violation of applicable minimum wage law, violation of workers compensation acts and violation of the Fair Labor Standards Act (FLSA).
Matthew Scarpinato filed a complaint on May 17 in the Pinellas Circuit Court against Florida Mobile Rehab LLC d/b/a Salus alleging that the corporation failed to compensate employees with proper wages and benefits.
According to the complaint, the plaintiff alleges that he has suffered monetary injury by routinely working in excess of 40 hours in a work week without being paid overtime compensation or the statutory minimum wage under the purported fee basis.
The plaintiff holds Florida Mobile Rehab LLC d/b/a Salus responsible because the defendant allegedly failed and refused to make payments of earned salary against the law, and forced plaintiff to retain counsel to protect his interest.
The plaintiff requests a trial by jury and seeks judgment against defendant for all damages and relief under the FLSA, including liquidated damages, attorneys’ fees, costs and expenses, in addition to all other relief the Court deems just.
