CLEARWATER — A shopper is suing a building and property owner, alleging insufficient measures were taken to prevent injuries.
Joanne Fort filed a complaint May 16, in the 6th Judicial Circuit of Florida - Pinellas County against Linco Auto Parts Inc. alleging that the defendant failed to maintain and/or adequately maintain its premises from dangerous conditions.
According to the complaint, the plaintiff alleges that on Feb. 10, 2018, she was shopping at Leslie's Pool Store, a tenant of the defendant's property, and while attempting to exit, she allegedly fell due to a faulty sidewalk, curb and pathway to the parking lot.
As a result, Fort allegedly suffered severe back injuries, pain and mental anguish; and incurred substantial medical bills.
The plaintiff holds Linco Auto Parts responsible because the defendant allegedly failed to maintain its property and premises in a reasonably safe condition, and in a condition that complied with all fire and building codes.
The plaintiff requests a trial by jury; and seeks damages in excess of $15,000 dollars, exclusive of interest, costs, attorney's fees, and any other relief the court considers just and proper. She is represented by Michael J. Boyle and Ian R. Leavengood of LeavenLaw in St. Petersburg.
