Driver claims Orange County Sheriff officers illegally seized and destroyed his iPad

ORLANDO — A Florida resident is suing two Orange County Sheriff officers, alleging negligence and violation of his constitutional rights.

Marlon Ricardo Anthony Pryce filed a complaint on May 15  in the Orange Circuit Court against Deputy Christopher Carriuolo and Sheriff Jerry Demings alleging that they breached their duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on May 15, 2014 he was approached by Carriuolo outside an Orlando coffee shop and told his car tint appeared darker than permitted by law. Pryce went into the coffee shop and when he exited he alleged Carriuolo performed an unlawful traffic stop of his vehicle. During the encounter, Pryce allegedly told the officer he was recording the incident on his iPad and refused to roll down his window for Carriuolo to test the level of the tint.

Carriuolo cited Pryce for having illegally tinted windows and then arrested him for resisting an officer without violence for not rolling down his window. He then allegedly confiscated the iPad. 

Pryce said the iPad was later destroyed by Demings while in police possession. 

The plaintiff holds Carriuolo and Demings responsible because they allegedly seized and destroyed his property without a search warrant or warrant exception.

The plaintiff requests a trial by jury; and seeks a judgment against the defendants for actual and compensatory damages, costs, attorney’s fees and such other relief as the court deems just. He is represented by Bradley N. Laurent of the Law Office of Haynes and Laurent PA in Orlando.
