Property owners sue management companies after suffering flood damage

CLEARWATER — Property owners are suing Terra Management Services LLC, Resource Property Management Inc. and BB&T Insurance Services Inc., management companies, citing alleged breach of fiduciary duty and intentional infliction of emotional distress.

Leona Broussard and Franck Belhassen filed a complaint on May 9 in the Pinellas Circuit Court against the defendants alleging that they breached their duties of good faith and fair dealing.

According to the complaint, the plaintiffs allege that since Dec. 30, 2017, Leona Broussard and Franck Belhassen have suffered a great deal of mental anguish, loss of enjoyment of life, financial hardship and loss of habitable dwelling because of damages to their property as a result of a flood. Although the defendants were properly notified of the significant damage, they have failed or refused to acknowledge the claim or provide the homeowner's insurance policy that holds coverage for the affected property. 

The plaintiffs hold Terra Management Services LLC, Resource Property Management Inc. and BB&T Insurance Services Inc. responsible because the defendants allegedly breached their fiduciary duty to plaintiffs by not providing a copy of the HOA insurance policy and by not acknowledging the claim.

The plaintiffs request a trial by jury and seek judgment against defendants for damages, plus attorney’s fees and costs. They are represented by Catherine F. Agacinski of Silver & Agacinski in Tampa.
