CLEARWATER — Two St. Petersburg property owners are suing an insurer, alleging breach of contract, due to refusal to acknowledge a policy claim.
Arturo Portugal and Ester Portugal filed a complaint May 7 in Pinellas County Circuit Court against Anchor Property & Casualty Inurance Company, alleging the defendant refused to pay coverage for water damage.
According to the complaint, on Dec. 16, 2015, the Portugal property at 6841 16th Way S., St. Petersburg, suffered damages due to the accidental discharge of flowing water caused by a broken pipe, while the policy was in full force and effect. The Portugals allege the property's insurance and other structures portions of the policy are based on "all risk" coverage.
The plaintiffs allege Anchor Property & Casualty Insurance has breached its duty by not acknowledging the claim and refusing to pay coverage for the loss.
The Portugals seek a trial by jury, damages exceeding $15,000, excluding court costs, interests, attorney fees and all other relief the court deems just and proper. They are represented by attorney David Low of David Low & Associates PA in Fort Lauderdale.
