St. Petersburg homeowner alleges insurer failed to pay for water damage

CLEARWATER — A St. Petersburg homeowner is suing an insurer, alleging breach of contract.

Cynthia Annet Martin filed a complaint May 2 in Pinellas Circuit Court against People's Trust insurance Company, alleging failure to pay for a covered loss due to water damage. 

According to the complaint, in 2017 Martin discovered water-leak damages to her insured property at 5080 64th St. N., St. Petersburgh. Although People's Trust authorized and agreed to pay for repairs and work, the suit says, some damages to the flooring and Martin's personal belongings were created during the course of repairs for which the defendant has refused to compensate the plaintiff.  

The plaintiff alleges People's Trust insurance has refused to adequately pay for the entire course of damage, refused to fully compensate her for all repairs and replacements, and forced Martin to retain legal counsel.

Martin seeks trial by jury, judgement in excess of $15,000, plus costs, interest, attorney fees, and any other relief the court deems proper. She is represented by attorney Robert W. Hitchens of Hitchens & Hitchens PA in St. Petersburg.
