Tamarac homeowner alleges insurance company failed to cover plumbing leak damage

FORT LAUDERDALE — A Florida homeowner is suing an insurance company, alleging breach of contract following a plumbing leak. 

Michael Raible filed a complaint April 25 in Broward County Circuit Court against Lexington Insurance Company, alleging failure to pay, replace and/or repair the full amount of damages.

According to the complaint, on Oct. 29, 2017, Raible's dwelling at 4909 NW 48th Ave., Tamarac, sustained damages due to a plumbing leak during the policy period. Raible says he notified Lexington of the damages and complied with all conditions precedent to recover the loss. However, the suit says, the defendant although acknowledging the claim, has refused to pay for the damages to the plaintiff's property.

The plaintiff alleges Lexington Insurance has refused to pay to replace and/or repair the full amount of damages that are due and owing.

Raible seeks trial by jury, damages that exceed $15,000, exclusive of attorney fees, court costs and interests on any overdue payments. He is represented by attorney Frederick Pye III of Morgan & Morgan, PA in Miami.
